Understanding Georgia Wrongful Death Law

When someone dies due to another person’s negligence โ€” a car accident, a truck crash, medical malpractice, a workplace accident, or any other preventable cause โ€” Georgia law allows specific family members to pursue a wrongful death claim.

Who Can File a Wrongful Death Claim in Georgia?

Georgia has a strict hierarchy (O.C.G.A. ยง 51-4-2):

  1. Surviving spouseย has the first right to file. If there are children, the spouse must share equally โ€” but the spouse’s share cannot be less than one-third.
  2. Childrenย may file if there is no surviving spouse.
  3. Parentsย may file if there is no surviving spouse or children.
  4. Personal representative of the estateย may file if there is no surviving spouse, children, or parents.

Critical note: Filing by the wrong party can result in dismissal. This is why legal counsel is essential from day one.

Two Types of Recovery

Georgia wrongful death law provides for two separate claims:

1. The “Full Value of the Life” Claim (O.C.G.A. ยง 51-4-1) This includes:

  • Economic value:ย Lost income, benefits, and financial support the deceased would have provided
  • Intangible value:ย Loss of companionship, guidance, care, nurturing, and the overall value of the person’s life to their family

2. The Estate Claim Filed by the personal representative of the estate:

  • Funeral and burial expenses
  • Medical bills incurred before death
  • Pain and suffering the deceased experienced between the injury and death
  • Punitive damages (where applicable)

Statute of Limitations

2 years from the date of death (O.C.G.A. ยง 9-3-33). In some cases, the discovery rule may apply โ€” but do not assume you have more time without consulting an attorney.

Punitive Damages

In cases involving egregious conduct โ€” drunk driving, willful safety violations, knowing indifference to human life โ€” punitive damages may be awarded under O.C.G.A. ยง 51-12-5.1. These damages punish the defendant and deter similar conduct.
