Truck crashes are different

The trucking company has a team. You should too.

A crash with an 18-wheeler, box truck or delivery van can change your life in a second. These cases involve bigger insurance policies, more rules and more people who may share the blame. Here is what we focus on first.

Evidence Can Disappear

Electronic driving logs, black box data, dashcam video and inspection records may not be kept for long. We move quickly to request that they be preserved.

More than One Party May Be Responsible

The driver, the trucking company, the company that loaded the cargo or maintained the truck can all play a part. We look at every one of them.

Serious Injuries Need a Full Picture

Truck crashes often cause serious injuries. We read your medical records closely and account for future care and lost income, not just today’s bills.

We don’t take a fee until you do.

What we investigate

How We Build a Georgia Truck Accident Case

Commercial trucks are covered by federal and Georgia safety rules. When those rules are broken, it can make the difference in your case.

1

Driver Hours and Logs

Electronic logging device (ELD) records show how long the driver was on the road and whether rest rules were followed.

2

Black Box and Dashcam Data

Truck data can show speed, braking and following distance in the seconds before the crash.

3

Driver Qualification File

Licensing, training, drug and alcohol testing and past violations can show whether the company should have put the driver on the road.

4

Maintenance and Inspections

Brake, tire and inspection records can reveal a truck that should not have been driving.

5

Cargo and Loading

Overloaded or badly secured cargo can cause rollovers and jackknifes, and can bring in the company that loaded it.

6

Company Responsibility

Georgia law can hold a trucking company responsible for its driver. Learn about vicarious liability.

As featured in Forbes

Empathy isn’t a slogan here. It’s how we build your case.

Forbes featured our founder, Attorney Harrell Gunn, for staying close to his cases while growing the firm: listening to clients, understanding what they’re going through, and investigating every detail.

Harrell reads every medical record in your file personally — not a summary, every page — and builds your case around the full impact of your injuries. That’s why the attorneys here return your calls, read your medical records, and treat your case like it matters. Because it does.

FAQ

Quick Answers

How much does it cost to hire you?

Nothing upfront. We work on a contingency fee, so you pay no attorney fee unless we recover money for you. We explain how case costs are handled in writing before you sign anything.

What if I am partly at fault?

Under Georgia law, you can still recover as long as you are less than 50% at fault, but your recovery is reduced by your share of the fault. Learn more about Georgia’s 50% rule.

How long do I have to file a claim?

In most Georgia injury cases, the deadline to file a lawsuit is 2 years from the date of the injury. Claims against a city, county or the state can require written notice much sooner, sometimes within 6 months. See our guide to the Georgia statute of limitations and call us early so evidence is not lost.

Who can be held responsible after a truck accident?

Depending on the facts, the truck driver, the trucking company, the owner of the trailer, the company that loaded the cargo, a maintenance shop or a parts maker may share responsibility. We investigate each one.

What evidence matters in a truck accident case?

Electronic driving logs, black box data, dashcam video, driver qualification files, drug and alcohol test results, inspection and maintenance records and the police report. Some of it may not be kept for long, which is why we act quickly.

Is the trucking company’s insurance different from a car insurance policy?

Usually, yes. Many commercial carriers must carry much higher liability coverage than a personal auto policy, and their insurers often have lawyers involved from the start.

Should I talk to the trucking company or its insurance adjuster?

Be careful. You do not have to give a recorded statement to the trucking company’s insurer, and early statements can be used to reduce your claim. Let your attorney handle those calls.

What if the truck driver was an independent contractor?

That does not always end the case against the company. Who controlled the driver and the truck, and whose operating authority the truck ran under, can matter. We review the contracts and records.
