Expect claims that you were weaving, invisible, or “came out of nowhere.” The answer is evidence: scene photos, ECM/vehicle data, helmet cam or dashcam footage, and independent witnesses.
Georgia Rules Riders Should Know
- Helmets are mandatory (O.C.G.A. § 40-6-315). Georgia requires DOT-compliant helmets and eye protection. Wearing yours removes an entire argument from the defense playbook.
- Lane splitting is illegal in Georgia. Riding between lanes of traffic gives the insurer a comparative-fault gift. Full lane use, however, is your legal right.
- Full lane rights. A motorcycle is entitled to the entire lane; a driver who crowds you out of it is the one breaking the rules.

- Stay off social media — one gym selfie becomes “he’s fine, your honor.”
- Check your own UM coverage; many at-fault drivers carry Georgia minimums that won’t cover one ER visit.
