Atlanta car accident lawyer

Car Accidents in Atlanta Are Serious. Your Lawyer Should Be Too.

Atlanta traffic isn’t just frustrating. It’s dangerous. The metro area consistently ranks among the worst in the country for congestion, aggressive driving and fatal crashes. In 2023, Georgia recorded 1,615 traffic deaths, and 523 of them happened in the 11-county Atlanta region.

If you’ve been hurt in a car accident in Atlanta, you’re dealing with more than a damaged vehicle. You’re looking at medical bills, time away from work, physical therapy, and insurance adjusters who are trained to pay you as little as possible. You need a car accident lawyer who knows Atlanta, knows Georgia law, and knows how to get full value for your claim.

That’s The Gunn Law Group. We’re Atlanta car accident lawyers who have recovered millions for crash victims across Metro Atlanta, including significant multi-million dollar recoveries for clients who suffered traumatic brain injuries and lost family members in auto accidents. We handle your case from the first phone call to the final settlement check, and you never pay an attorney fee unless we recover for you.

Know the roads

Atlanta’s Most Dangerous Roads and Intersections

If you drive in Atlanta, you already know these roads. They’re where most serious accidents happen.

Interstate 285 (The Perimeter)

I-285 loops 64 miles around Metro Atlanta and carries over 200,000 vehicles per day in some sections. High speed, heavy merging and commercial truck traffic make it one of the most dangerous highways in the Southeast. Common crash zones include the I-285/I-85 interchange, the I-285/GA-400 interchange and the I-285/I-20 interchange on the west side.

Interstate 85

I-85 cuts through the heart of Atlanta, connecting Midtown to Buckhead and running northeast toward Gwinnett County. The corridor between Downtown and Spaghetti Junction sees constant stop-and-go traffic, rear-end collisions and multi-vehicle pileups, especially during the morning and evening rush.

I-75 and the Downtown Connector

Where I-75 and I-85 merge through Downtown Atlanta, drivers face one of the most congested stretches of highway in America. Lane changes, construction zones and sudden slowdowns create a recipe for serious crashes.

Georgia 400

GA-400 runs north from Buckhead through Sandy Springs, Roswell and Alpharetta. The GA-400/I-285 interchange is a frequent collision zone, and the corridor sees high-speed rear-end accidents, particularly in the evening commute.

Spaghetti Junction (I-85/I-285)

This multi-level interchange in DeKalb County earned its nickname for a reason. Lanes merge, split and cross in every direction. Confusion, lane changes and speed differentials all contribute to crashes.

Surface Streets

Peachtree Street (all of them), Memorial Drive, Buford Highway, Jimmy Carter Boulevard, Roswell Road and Piedmont Road are among the most accident-prone surface streets in Metro Atlanta. Pedestrian and cyclist accidents are also common on these roads.

Crash types

Types of Car Accidents We Handle

Rear-end Collisions

The most common type of crash in Atlanta traffic. Rear-end collisions cause whiplash, herniated discs, concussions and soft tissue injuries that may not show symptoms for days. The rear driver is usually found at fault, but insurance companies still try to minimize your injuries.

T-bone (Side Impact) Crashes

When a vehicle runs a red light or stop sign and strikes the side of another car, the occupants on the impact side face devastating injuries: broken bones, internal organ damage and traumatic brain injuries.

Head-on Collisions

The most deadly type of car accident. Head-on crashes happen on two-lane roads, at highway on-ramps, and when drowsy or impaired drivers cross the center line. Even at moderate speeds, the combined force is catastrophic.

Multi-vehicle Pileups

I-285, I-85 and the Downtown Connector are prone to chain-reaction crashes. These cases involve complex liability analysis, multiple insurance policies and often catastrophic injuries.

Hit-and-run Accidents

If the at-fault driver fled the scene, you may still have options. Your uninsured motorist (UM) coverage can provide compensation, and we work with Atlanta police and traffic cameras to help identify the responsible driver.

Distracted Driving Accidents

Texting, phone use, GPS adjustments, eating. Georgia’s Hands-Free Law (O.C.G.A. § 40-6-241) prohibits holding a phone while driving, but violations happen constantly. We use phone records and witness testimony to prove distraction.

Drunk and Impaired Driving Crashes

Georgia’s DUI law (O.C.G.A. § 40-6-391) sets the BAC limit at 0.08%. If you were hit by an impaired driver, you may be entitled to both compensatory and punitive damages. Learn more about DUI accident claims in Atlanta.

Georgia law

Georgia Car Accident Laws You Need to Know

Fault-based System

Georgia is a fault-based (also called “tort”) state for car accidents. The driver who caused the accident is responsible for the injuries and damages. You can pursue a claim against the at-fault driver’s liability insurance, file a claim through your own insurance, or file a lawsuit.

Modified Comparative Fault (O.C.G.A. § 51-12-33)

Georgia’s modified comparative fault rule allows you to recover damages as long as you’re less than 50% at fault. Your recovery is reduced by your percentage of fault. For example, if you’re 10% at fault and your damages total $200,000, you’d recover $180,000.

Insurance adjusters exploit this rule aggressively. They’ll argue you were speeding, distracted or failed to take evasive action, anything to shift blame and reduce your payout. This is exactly why you need an experienced Atlanta car accident lawyer on your side.

Georgia Minimum Insurance Requirements

Required coverageGeorgia minimum
Bodily injury liability, per person$25,000
Bodily injury liability, per accident$50,000
Property damage liability$25,000

These minimums are dangerously inadequate. A single ER visit with imaging can exceed $25,000. If the at-fault driver carries only the minimum, your own uninsured/underinsured motorist (UM/UIM) coverage becomes essential, and whether you have add-on or reduced-by UM matters. We evaluate every available policy to maximize your recovery.

Statute of Limitations (O.C.G.A. § 9-3-33)

You have two years from the date of the accident to file a personal injury lawsuit in Georgia. If a family member died in the crash, the wrongful death deadline is also generally two years from the date of death. Property damage claims have four years. Claims against a city, county or the state can require written ante litem notice much sooner. Missing a deadline can permanently bar your claim. See Georgia’s statute of limitations.

Georgia’s Hands-Free Law (O.C.G.A. § 40-6-241)

Since July 2018, Georgia drivers cannot hold a phone while driving. You can use hands-free features (Bluetooth, a mounted GPS), but physically holding or supporting a phone is illegal. If the other driver violated this law, it’s strong evidence of negligence for your claim.

After a crash

What to Do After a Car Accident in Atlanta

The steps you take immediately after a crash directly impact the value of your case. Here’s what we tell every client.

1

Call 911 and Report the Accident

Georgia law (O.C.G.A. § 40-6-273) requires you to report any crash with injuries, deaths or property damage of $500 or more. The police report is a critical piece of evidence.

2

Get Medical Attention, Even If You Feel Fine

Adrenaline masks pain. Concussions, internal bleeding, herniated discs and soft tissue damage often don’t produce symptoms for 24–72 hours. Medical records create a documented link between the crash and your injuries.

3

Document Everything at the Scene

Photograph all vehicles, damage, skid marks, traffic signals, road conditions and visible injuries. Get the other driver’s name, insurance, plate and contact details, plus witness names and numbers.

4

Do Not Admit Fault

Don’t say “I’m sorry” or “I didn’t see you.” These statements can be used against you. Stick to the facts when talking to police.

5

No Recorded Statement to the Other Insurer

Their adjuster will call quickly, often within hours, fishing for statements they can twist. Politely decline and tell them your attorney will be in touch.

6

Call The Gunn Law Group at 888-BIG-GUNN

The sooner we’re involved, the sooner we can preserve evidence, send spoliation letters if needed, and begin building your case. The consultation is free.

What you’re up against

How Insurance Companies Try to Shortchange Atlanta Car Accident Victims

Insurance companies are not on your side. Their business model depends on paying out as little as possible. Here’s how they do it.

The Quick Lowball Offer

Within days of your accident, the adjuster calls with a “generous” settlement offer, usually a fraction of what your case is actually worth. Once you accept, you can’t go back.

Blaming You for the Accident

Georgia’s comparative fault rule gives insurers a weapon. They’ll argue you were speeding, distracted or made the wrong move, anything to push your fault percentage up and your payout down.

Disputing Your Injuries

They’ll claim a “pre-existing condition,” a “gap in care,” or that your treatment was excessive, and may hire their own doctors to minimize your condition.

Surveillance and Social Media

Adjusters monitor your social media. A photo at a family barbecue can be used to argue you’re not really hurt. We advise all clients to stay off social media during their case.

Stalling

If they can delay long enough, past the statute of limitations or until you’re desperate enough to accept a low offer, they win. We don’t let that happen.

The Recorded Statement

An early recorded statement is used to lock in your words before you know the full extent of your injuries. We handle those calls for you.

Compensation

FAQ

Frequently Asked Questions About Car Accidents in Atlanta

What should I do if the other driver doesn’t have insurance?

Georgia requires all drivers to carry liability insurance, but not everyone complies. If the at-fault driver is uninsured, your own uninsured motorist (UM) coverage can compensate you for injuries. We’ve recovered significant settlements on uninsured motorist claims, and we’ll review every available policy to find coverage.

How long do I have to file a car accident claim in Georgia?

Under O.C.G.A. § 9-3-33, you have two years from the date of the accident to file a personal injury lawsuit. Don’t wait until the deadline approaches: critical evidence can be lost, witnesses move away, and surveillance footage gets erased. Call us as soon as possible after your accident.

Can I still get compensation if I was partially at fault?

Yes, as long as you were less than 50% at fault. Georgia’s modified comparative fault law (O.C.G.A. § 51-12-33) reduces your compensation by your percentage of fault but doesn’t eliminate it entirely. Insurance companies will try to blame you. We push back.

How much is my car accident case worth?

That depends on the severity of your injuries, medical costs, lost income, pain and suffering, and the available insurance coverage. Minor injury cases may settle for tens of thousands; catastrophic injury and wrongful death cases can be worth millions. We’ll give you an honest assessment during your free consultation.

Should I see a doctor even if I feel fine after the accident?

Absolutely. Many serious injuries, like concussions, herniated discs, internal bleeding and soft tissue damage, don’t show symptoms immediately. A medical evaluation creates a documented record connecting your injuries to the accident. Gaps in medical treatment give insurance companies ammunition to deny your claim.

Will my case go to trial?

Most car accident cases settle before trial. However, if the insurance company refuses to make a fair offer, we’re fully prepared to go to court. Insurance companies track which law firms actually try cases, and that leverage helps in negotiations.

What if the other driver’s insurance company is calling me?

Don’t give them a recorded statement. Don’t discuss your injuries. Don’t accept any offers. Politely tell them your attorney will be in contact and call us at 888-BIG-GUNN. Their adjuster is not trying to help you. They’re looking for reasons to pay less.

You Didn’t Cause This. Don’t Let the Insurance Company Decide What It’s Worth.

The insurance adjuster has a budget to protect. We have a client to protect. The two are not the same. Call The Gunn Law Group at 888-BIG-GUNN (888-244-4866) for a free consultation. We’ll tell you what your case is actually worth, and then we’ll go get it.
